Terms of Service
1. Scope of Application
Our terms and conditions apply to anyone who uses (hereinafter referred to as “the user”) the rental Wi-Fi router, and/or the rental accessories (hereinafter referred to as “devices”), provided by Rabbit Japan LLC(hereinafter referred to as “our company”). Any dates designated hereinafter will be based on local Japan time.
2. Completion of Contract
Provided to users according to our terms of agreement.
The rental contract between our company and the user is complete when the user submits and application on our website (http://www.rainbowifi.com), and payment is complete. User must read, understand and agree to the terms of agreement before applying. Application will be declined in the following cases.
- If provision of service is difficult due to inventory condition of device.
- If the user violates the terms of agreement, or if risk of violation is present.
3. Rental Period
Rental period will be determined by the dates set by the user at the time of application.
4. Extension or Changes to Contract
If the user wishes to change the content of the contract, he/she must notify and seek the permission of our company 3 days prior to the starting date, regardless of date of application.
If the user wishes to extend the period of use, he/she must notify and seek the permission of our company. In such case, an extension fee will be imposed. If the user continues to use the device without prior notification to our company, an extension fee will be charged up until the day the user contacts our company.
As a general rule, rental charges are non-refundable even if the device is returned early within the rental period.
Rental period cannot be changed after the device has been shipped.
Our company does not provide refunds for early returns.
5. Cancellation Policy
If the user wishes to cancel the contract, he/she must immediately contact our company.
Regardless of the date of application, a cancellation fee of ¥3,000 per device will be charged starting from 3 business days prior to use.
Cancellations cannot be made once we ship the device, in which case the user is responsible for all rental costs.
The user will pay the designated rental fee in advance.
The user will pay the following fees after the device is returned.
- Additional rental fees
- Extension fees
- Shipping and fees for other options will be charged separately.
7. Data Limit
If the user exceeds the amount of data transmission designated by the provider, the provider will put a restriction on the amount of data being used.
The amount of data transmission designated by the provider is subject to change without prior warning.
If while using the device and a restriction is placed on the use of data transmission, our company will not be held liable.
8. Payment Method
Payment will automatically be charged to the credit card designated by the user (hereinafter referred to as the designated card).
9. Extension Fees
If the user returns the device after the rental period has ended, our company will charge late fees on top of the rental fee.
A late charge of \972 (tax included) per day will be charged to the user’s credit card.
10. Management and loss, damage, water damage and theft of device.
The user is responsible and held accountable for any theft, loss or damage done to the device (hereinafter referred to as “Theft and etc.”) , from the time the device is handed to the user, until it is returned, and is liable for the cost of the device.
In the event that the device is stolen, the user is responsible for the data packet charges.
In the event that the device is stolen, and after the user has been charged for the cost of the device, and the device happens to be found, the user will not be given a refund for the cost of the device.
11. Prohibited matters
Adding other accessories to the device, remodeling the device or changing the properties of the device by the user is strictly prohibited.
The user must not take out the SIM card in the device and insert it into another device for use.
The user must not share, pawn, or sublet the rights of the device or our company to third parties, or violate any other rights related to the use of the device.
12. Range of Service
Please understand that even within the service area, reception may be obstructed due to buildings, or interference from other providers.
If reception is obstructed due to reasons given above, our company will not be held liable.
13. Picking up your device
The device will be shipped to the designated location selected or written on the form at the time the user made the application.
The user is responsible for checking the device upon receiving it, and notifying our company if a defect is found.
If there is no contact from the user within two days of receiving the device, our company will assume that the product has been received.
The user is responsible for shipping the device to our company by the end of the rental period (as designated in the rental contract).
Devices must be returned to the “return counter” at each airport.
15. Scope of Liability
Our company will only be liable for damages that do not exceed the amount of rental service and rental fees, regardless of the cause of damage.
16. Cancellation of the Rental Contract
Our company holds the right to cancel this contract at any time without warning if any of the following applies.
In such case, our company also holds the right to suspend the line of communication.
- If the user provided untruthful information in the application.
- If the credibility of the user becomes significantly questionable.
- If a violation of this contract is evident.
- If it is evident that the use or purpose of use of the device is not conducive to maintaining public order and moral decency.
In the event that the contract is cancelled due to conditions mentioned above, the user must return the device immediately, and will be held liable for all damages and expenses that incur.
In the event that the device, malfunctions or appears defective, due to no fault of the user during the rental period, or if the device does not function properly, our company will provide a replacement device as soon as possible.
If after our company checks the device, and a malfunction or problem is confirmed, the rental fees for the rental period will be prorated according to the days used, and refunded to the customer.
The scope of liability regarding malfunction or defective rental devices, is limited to the malfunction or defects of the products provided by our company. Our company will not be held for defects or malfunctions caused by the following situations.
- Malfunctions due to improper use or handling of the device by the user.
- Malfunction due to incompatibility of the user’s personal device/accessories, regarding use, operation, settings, or device.
- Malfunctions due to applications provided by telecommunications companies, service providers and such.
- Malfunctions due to the environment in which the user is actually using the product, such as geography, buildings, radars, household appliances and other types of interference.
- Due to malfunctions owed to acts of God.
- Suspension of use due to limitations placed on exceeding data packet designated by the telecommunication companies.
- Other malfunctions that are not the responsibility of our company.
Our company will do everything it its power to protect our customer’s privacy according to the standards of law and all other standards that apply.
Personal information gathered by our company will only be used for the purpose, or for related reasons disclosed at the time acquired by the user, and within reasons necessary for conducting business.
Any information provided to our company that is suspected to be harmful or intended for fraudulent use of our company will be shared with third parties or other network shops for the prevention of fraudulent orders.
Further, any personal information shared with third parties, or if handling of personal information is commissioned to third parties, will be governed to ensure that personal information is properly and lawfully used.
Our company will implement various necessary security measures to prevent leakage, loss or misuse of personal information that we acquire from our customers.
20. Jurisdiction Court
All disputable matters pertaining to contracts between our company and the user will be settled under the jurisdiction of the Tokyo District or Summary Court.
21. Amendments to the Terms of Agreement
The Terms of Agreement are subject to amendment without the consent of or notification to our users. Users are required to adhere to the amendments to the terms and regulations of the agreement of the rental contract.
